                Meeting Called to Order by Chairman Cahalane at 6:30 p.m.
                Town Hall, Conference Room #1.

                MINUTES:

                Monday, March 21, 2005 Regular Session:

                Motion made by Selectman Taylor to approve the Regular Session
                minutes of Monday, March 21, 2005 as presented.
                Motion seconded by Selectman Myers.
                VOTE:  Unanimous.  3-0.
                Selectman Green, Selectman Marsters abstained.

                Thursday, March 31, 2005 Regular and Executive Sessions:

Motion made by Selectman Myers to approve the Regular and Executive Session minutes of Thursday, March 31, 2005 as presented.
Motion seconded by Selectman Green.
VOTE:  Unanimous.  5-0.

APPOINTMENTS AND HEARINGS:

Public Comment:
Barnstable County Commissioners – Available Funds:

Marcia King, Mashpee’s representative to the Assembly of Delegates
was pleased to announce the availability of additional County funds for fiscal year 2005.  Based upon the allocation methodology, the Town of Mashpee will receive $15,902.

Correspondence was received from the Barnstable County Commissioners dated March 28, 2005 regarding the surplus funds in the amount of $276,000 that would be distributed to the fifteen Cape towns.

                APPOINTMENTS AND HEARINGS:

                Public Comment:

In other business, Mashpee residents Liz Kenner and Mickey LaCasse of Coombs Road related concern with respect to the disrepair of their private road.  In response it was noted that the Selectmen’s Office remitted criteria to the residents in response to emergency repairs to private roads.  The residents were also given the option to make payment to the Town to conduct necessary repairs.  It was agreed that the matter would be further reviewed with the Director of Public Works.

NEW BUSINESS:

Certification and Confirmation of Appointment Process – Firefighter/EMT:

George Baker, Fire Chief was present to request the Board’s certification of the appointment of Frank Nunes as Firefighter/EMT.  Correspondence was received from Chief Baker dated March 31, 2005 relative to the hiring process.  Mr. Nunes is a Mashpee resident.  The proposed date of hire is May 1, 2005.

Motion made by Selectman Myers to certify and confirm the appointment of Frank Nunes as Firefighter/EMT.
Motion seconded by Selectman Marsters.
VOTE:  Unanimous.  5-0.

Recommendation for Bid Acceptance – DPW Extension of Annual Bids:

Gregory Taylor, Director of Public Works presented a list of contracts for annual bid items to be extended for fiscal year 2006.  The bid items as listed were outlined in a memorandum from the Assistant DPW Director dated march 16, 2005.

Motion made by Selectman Marsters to approve the Extension of Contracts for the Annual Bid Items as listed for Fiscal Year 2006.
Motion seconded by Selectman Green.
VOTE:  Unanimous.  5-0.

NEW BUSINESS:

Acceptance of Retirement – Department of Public Works:

Communication was received from Larry Dove regarding his retirement as Foreman of the Department of Public Works effective August 24, 2005.

Motion made by Selectman Green to accept with regret, the retirement of Larry Dove from the DPW.
Motion seconded by Selectman Marsters.
VOTE:  Unanimous.  5-0.

APPOINTMENTS AND HEARINGS:

Community Preservation Coalition – Dorrie Pizzella:

Dorrie Pizzella gave an in-depth presentation to the Board of Selectmen regarding the implementation of the Community Preservation Act.  An article appears on the May Town Meeting warrant regarding the creation of a Community Preservation Committee that would be effective after the passage by ballot of the Community Preservation Act.

The CPA is a new tool to help communities preserve open space and historic sites, and create affordable housing and recreational facilities.  The CPA allows participating cities and towns to adopt a real estate tax surcharge up to 3% to fund three key community purposes; open space, historic preservation and community housing.  Additional information may be found on the website www.communitypreservation.org.

The Committee shall consist of (9) voting members; one member of the Conservation Commission, one member of the Historical Commission, one member of the Planning Board, one member of the Board of Selectmen acting as Park Commissioners, one member of the Mashpee Housing Authority, and four at-large members appointed by the Board of Selectmen.

                APPOINTMENTS AND HEARINGS:

                Public Hearing – Mashpee Commons Entertainment:

The Board of Selectmen opened the Public Hearing on the application of Mashpee Commons Limited Partnership to provide entertainment to the public from April 22, 2005 to December 31, 2005.  The Entertainment would be held in Mashpee Commons, Mashpee, MA.

The Town Manager read aloud the Public Hearing notice as published.  Mashpee Commons representative Lissa Lindsley was present to discuss the license application with the Board of Selectmen.  The 2005 calendar of events includes family movies on Friday evenings.  Additional information can be found on the website www.mashpeecommons.com.

                Being no comment, the Board motioned to close the Public Hearing.

                Motion made by Selectman Marsters to close the Public Hearing.
                Motion seconded by Selectman Myers.
                VOTE:  Unanimous.  5-0.

Motion made by Selectman Marsters to approve the application of Mashpee Commons Limited Partnership to provide entertainment to the public in Mashpee Commons from April 22, 2005 to December 31, 2005.
Motion seconded by Selectman Taylor.
VOTE:  Unanimous.  5-0.

Public Hearing – Planet Restaurant, Inc. d/b/a Giovanni’s Request to Change d/b/a to Sopranos:

The Board of Selectmen opened the Public Hearing on the application of Planet Restaurant, Inc. d/b/a Giovanni’s to change their d/b/a name to Soprano’s, 681 Falmouth Road, Mashpee.

The Public Hearing notice was read aloud in accordance with posting procedures.  Edmond Richardi, applicant and President of the establishment was present to discuss the doing business as name change with the Board of Selectmen.  Mr. Richardi indicated that he is presently awaiting final inspections and anticipates opening in late May.

Being no comment, the Board motioned to close the Public Hearing.

Motion made by Selectman Myers to close the Public Hearing.
Motion seconded by Selectman Taylor.
VOTE:  Unanimous.  5-0.

Motion made by Selectman Myers to approve the application of Planet Restaurant, Inc. d/b/a Giovanni’s to change their d/b/a name to Soprano’s 681 Falmouth Road, Mashpee, and approve an extension of opening to Memorial Day, May 31, 2005 dependant upon the Board of Health’s final sign-off and approval.
Motion seconded by Selectman Green.
VOTE:  Unanimous.  5-0.

NEW BUSINESS:

Friends of the Council on Aging – Thrift Shop Building Project:

Friends of the Mashpee Council on Aging were present to request the Selectmen approve a new thrift store building to be built on proper location at the site of the new Senior Center.  Detailed specifications were provided for the new 28 x 32’ building.

Motion made by Selectman Taylor to approve the construction of a new thrift store building at the site of the new Senior Center as presented.
Motion seconded by Selectman Myers.
VOTE:  Unanimous.  5-0.

                NEW BUSINESS:

                Request of Law Dawgs Motorcycle Club – Memorial Ride:

Ben Perry, President of the Law Dawgs Motorcycle Club was present to request the Selectmen support the club’s fundraising event on Saturday, May 21, 2005.  The event, a memorial motorcycle ride and blessing is held in the memory of the late Corporal William A. Paolini, Sr.  Funds raised by the event support scholarships in Mr. Paolini’s name to graduating students of Mashpee’s senior class.

Motion made by Selectman Marsters to approve the request of the Law Dawgs Motorcycle Club as outlined.
Motion seconded by Selectman Taylor.
VOTE:  Unanimous.  5-0.
